Agents gave a 12 month tenancy agreement instead of 6

Our agents gave our tenants a 12 month tenancy agreement without our knowledge. We assumed it would be for 6 months as usual. We wish to sell the house after 6 months. Are they responsible for sorting this out?

  • Check the landlord break clause in the tenancy agreement assuming your agent uses a break clause, it is probably a 12 month tenancy with a 6 month break clause but to exercise this you must ensure you tell your agent to serve notice to the tenants at the 4th month. If you are selling the sales market is not great I would continue to let if you have the break clause as after the 6 months you can serve 2 months notice at any point and it usually takes 8 weeks for a sale to go through depending on the chain
